Housing contract registration
EU & Non-EU
Registering a rental agreement with the Agenzia delle Entrate, if renting.
Most tenants never think about their lease again after signing it — which is exactly the problem, because in Italy the contract isn't legally live until someone registers it with the Agenzia delle Entrate, and that someone is supposed to be your landlord, not you.
The law gives 30 days from signing (or from whenever the apartment was actually handed over, if that happened first) to register it, and while the obligation formally sits with the landlord, tenants are jointly liable for the registration itself — which is the part worth caring about, because an unregistered lease can come back to bite you later, particularly when the Comune asks for a registered contract during residence registration and there isn't one to show. It's a reasonable question to ask your landlord directly, rather than assuming it's been handled.
Registration itself happens one of two ways: online through the Agenzia delle Entrate's RLI service (usually done by an agency, commercialista, or CAF with Fisconline credentials), or in person at any Agenzia delle Entrate office with two original signed copies of the contract, a completed modello RLI, and proof of the registration tax and stamp duty payments. What that costs if it's late depends on the tax regime the landlord picked: under the ordinary registration-tax regime, registering up to 30 days late costs a penalty of 45% of the tax due (minimum €150), and beyond 30 days it jumps to 120% (minimum €250) — but a 2025 clarification from the Agenzia delle Entrate (Risoluzione 56/E) simplified this for the more common cedolare secca flat-tax contracts, which now carry a fixed late-registration penalty of €150 or €250 depending on how late it is, rather than a percentage calculation. Either way, self-correcting before the Agenzia opens any enforcement action (ravvedimento operoso) cuts the penalty down substantially. None of this is something you can force a landlord to do, but you can ask to see the registration receipt once it's done — it's a fair thing to want proof of.
